House Rules

We are very strict about our property rules. By booking this property, Guest agrees to follow all rules listed in this Agreement. **No parties. No smoking inside. No illegal drugs or substances. No unauthorized guests.** A **$200 pet fee** must be paid before entry if pets are approved. Please note that the HOA manager resides below the unit, and all rules are strictly enforced. If rules are broken, Guest may be required to leave the property immediately with no refund. Guest must follow this Rental Agreement in full. --- ## Rental Agreement and Contract This Rental Agreement and Contract, referred to as the “Agreement,” is a legally binding agreement made and entered into as of the reservation date by and between the undersigned guest, referred to as “Guest,” and the owner, manager, or authorized rental agent, referred to as “Rental Agent.” Guest has agreed to rent the residence described in the reservation, referred to as the “Property,” for the rental term, total rental fee, and other terms listed in this Agreement and/or on the reservation platform. --- ## Occupancy Guest agrees that no more than **8 total persons**, including children, shall be permitted to stay overnight at the Property during the rental term. All guests must comply with the rules and restrictions in this Agreement. Guest must provide a valid photo ID upon request. No persons other than those included in the reservation may stay overnight at the Property. All persons staying at or visiting the Property must be registered or approved for insurance and safety purposes. Guest may have up to **2 additional daytime visitors**, but visitors may not stay overnight without prior written approval. Maximum occupancy is strictly enforced. --- ## Condition and Use of Property The Property is provided in its current condition. Rental Agent will make reasonable efforts to ensure that all amenities are working, including internet, appliances, video game consoles, hot tubs, pools, spas, fireplaces, and other provided items. However, Rental Agent is not responsible for temporary failure of any amenity, utility, or equipment. Rental Agent will make reasonable efforts to correct reported issues as quickly as possible. Guest acknowledges that use of amenities, including but not limited to pools, hot tubs, spas, decks, balconies, stairs, fireplaces, beach areas, and similar features, may involve risk. Guest and all members of Guest’s party use these amenities at their own risk. Guest shall use the Property for residential vacation purposes only and shall use the Property in a careful, safe, and respectful manner. Guest must keep the Property clean and sanitary at all times. Guest and all permitted guests must not disturb neighbors, create excessive noise, endanger others, violate HOA rules, violate local laws, or use the Property for any unlawful, offensive, dangerous, or improper purpose. --- ## Default and Rule Violations If Guest fails to comply with this Agreement, the house rules, HOA rules, or any applicable law, Guest may be required to immediately leave the Property. In the event of a serious rule violation, no refund will be issued for any unused portion of the stay. If legal action is necessary to enforce this Agreement, the prevailing party may be entitled to recover reasonable costs, fees, and expenses as permitted by law. --- ## Assignment or Sublease Guest may not assign, transfer, or sublease the Property. Guest may not allow any person not listed or approved on the reservation to use, occupy, or stay at the Property. --- ## Risk of Loss and Personal Property Guest agrees that all personal belongings, valuables, vehicles, and other items brought onto the Property are kept at Guest’s sole risk. Rental Agent, Property owner, employees, contractors, and representatives are not responsible for theft, loss, damage, or destruction of Guest’s personal property for any reason. --- ## Indemnification Guest agrees to indemnify, defend, and hold harmless Rental Agent, Property owner, employees, contractors, representatives, successors, and assigns from any claims, damages, costs, liabilities, injuries, losses, attorney fees, or expenses arising out of Guest’s stay, Guest’s actions, the actions of any person in Guest’s party, or the use of the Property and its amenities. --- ## Release of Liability Guest waives and releases any claims against Rental Agent, Property owner, employees, contractors, and representatives for injury, illness, accident, loss, or death that may occur on, near, or around the Property, including common areas, amenities, parking areas, pools, beach areas, stairs, decks, balconies, and other shared or public spaces. Guest agrees that all use of the Property, amenities, common areas, and nearby beach areas is at Guest’s own risk and responsibility. --- ## Security Cameras Guest acknowledges that there are exterior security cameras at the Property, including Ring-style doorbell cameras at the entrances. These cameras are for safety and security purposes. There are **no cameras inside the condo**. Guest may not cover, disable, tamper with, disconnect, or interfere with any exterior camera or security device. --- ## Entry and Inspection Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for inspection, repairs, maintenance, or other necessary purposes. If Rental Agent has a reasonable belief that there is an emergency, safety concern, rule violation, property damage, or risk to any person or property, Rental Agent may enter the Property without advance notice. --- ## Unavailability of Property If the Property becomes unavailable for reasons beyond the control of Rental Agent, Rental Agent will make reasonable good-faith efforts to locate a comparable replacement property, if available. If a comparable replacement property cannot be located or made available, Rental Agent shall refund payments made for the unavailable portion of the reservation, and this Agreement shall terminate with no further liability to either party. --- ## General Provisions This Agreement contains the entire agreement between Guest and Rental Agent regarding the rental of the Property. Any changes, amendments, or modifications must be in writing and approved by Rental Agent. This Agreement shall be governed by the laws of the State of Mississippi. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives, and assigns where applicable. Failure to enforce any provision of this Agreement shall not be considered a waiver of that provision or any other provision. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Any required notices must be made in writing through the reservation platform or other approved written method. This Agreement may be signed or accepted electronically, and electronic acceptance shall have the same effect as a written signature. --- ## Check-In and Check-Out Check-in time is **after 4:00 PM Central Time**. Check-out time is **10:00 AM Central Time**. Early check-in and late check-out are not permitted unless approved in writing in advance. Our cleaners follow a strict schedule. Unauthorized late check-out may result in additional charges. --- ## Smoking Smoking and vaping are not allowed inside the condo, garage, or any prohibited HOA/common areas. If there is evidence of smoking, vaping, smoke odor, or smoke contamination inside the Property, a minimum additional cleaning fee of **$400** may be charged. Guest is responsible for properly disposing of all cigarette butts, ashes, and related debris.
